Article 2 – Scope

These general terms and conditions of sale (T&Cs) apply to any sale concluded on the website between La Tradition de l'Écriture and any person (hereinafter “the Customer”). The Customer declares having read and accepted them before placing an order. The applicable version is the one online on the day of the order.

Article 3 – Products

The items offered are for the most part antique or collectible objects, often unique pieces. Each item is described and photographed with the utmost care; its condition (wear, restoration, patina) is specified in its product sheet. The photographs form part of the description. Offers are valid while stocks last.

Article 4 – Prices

Prices are stated in euros, inclusive of all taxes, excluding shipping costs, which are specified before the order is confirmed. For shipments outside the European Union, any customs duties and import taxes remain the responsibility of the Customer.

Article 5 – Orders

The Customer selects the items, checks the contents of the cart, enters their details, chooses the delivery and payment methods, then confirms the order. A confirmation is sent by e-mail. The sale becomes final only upon receipt of payment. La Tradition de l'Écriture reserves the right to cancel any order from a Customer with whom there is a dispute concerning payment for a previous order.

Article 6 – Payment

Payment is made online using the methods offered at the time of ordering (in particular PayPal and bank card via PayPal), by bank transfer or by cheque. The items remain the property of La Tradition de l'Écriture until the price has been paid in full.

Article 7 – Delivery

Items are delivered to the address given by the Customer, according to the terms and rates set out on the Delivery page. Should a parcel arrive damaged, the Customer is asked to record precise reservations with the carrier and to notify us within 48 hours, with supporting photographs.

Article 8 – Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code (Code de la consommation), a Customer who is a consumer has a period of fourteen days from receipt of the item to exercise their right of withdrawal, without having to give any reason. It suffices to inform us by an unambiguous statement (by e-mail to eric.le-cour@orange.fr or by post), then to return the item in its original condition and carefully packed, within fourteen days of that statement. Return costs are borne by the Customer. The refund, including the initial delivery costs (on the basis of the standard shipping method), is made within fourteen days of receipt of the withdrawal; it may be deferred until the item has been received back.

Article 9 – Legal guarantees

The items benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against latent defects (Articles 1641 et seq. of the French Civil Code). For second-hand goods, any lack of conformity that becomes apparent within twelve months of delivery is presumed to have existed at the time of delivery. These guarantees do not cover normal wear or the aged condition of the item as described in its product sheet.

Article 10 – Personal data

The data collected is processed in accordance with our privacy policy.

Article 11 – Mediation and disputes

In the event of a complaint, the Customer may contact us at eric.le-cour@orange.fr. Failing an amicable settlement, a Customer who is a consumer has the right to refer the matter, free of charge, to a consumer mediator, in accordance with Articles L611-1 et seq. of the French Consumer Code. These T&Cs are governed by French law.
